We need to know the detailed process on how we get the working permits for helpers from foreign.

Is it connected to the NGO title?

EMPLOYMENT TERMS AND CONDITIONS OF SERVICE

1. PROBATION.
You will serve the Project from the effective date for an indefinite period subject to termination as set out in the Notice Period overleaf.

2. DESIGNATION
You will serve the Project as designated overleaf or in such other capacity as the Project may from time to time reasonably require.

3. PLACE OF WORK.
You will serve the Project at any of its offices or branches or with any subsidiary or associate Projects or successors in Mombasa or in such other places in Kenya or outside Kenya as the Project may reasonably require.

4. SALARY REVIEW.
Your salary will be paid each month in arrears and may at the sole discretion of the Project be reviewed on 1st January in each year.

5. ANNUAL LEAVE.
You are entitled to annual leave as set out overleaf for each completed year of service, such leave to be taken at the convenience of the Project. Leave may not be accumulated from year to year except as set out overleaf. The Project will not pay cash in lieu of leave not taken. Normally all leave for one year will be taken at one time. Leave will invariably start on a Monday and will be for a minimum period of seven consecutive days. Saturdays and Sundays are included but public Holiday is excluded from calculation of the leave days.

6. SICK LEAVE.
Subject to satisfactory medical evidence being produced to the Project within three days of absence through sickness you will be entitled to sixty days sick leave on full pay per annum and no more except at the Project’s sole discretion. Sick leave cannot be accumulated from year to year.

7. MATERNITY LEAVE.
Subject to satisfactory medical evidence being produced to the Project, female employees are entitled to two months maternity leave on full pay in which case such persons shall forfeit their annual leave for that year.

8 TERMINATION BY NOTICE.
If during your period of service either the Project or you should wish to terminate the appointment either party must either:
(a). Give notice of termination as stipulated overleaf, or
(b) Give a lesser period of notice and at the same time pay to the other the equivalent of salary for the period by which the notice given falls short of the period stipulated overleaf.


9. SUMMARY DISMISSAL
If you commit any serious breach of your obligation under this Agreement which obligations include but are not limited to those set out in section 17 of the Employment Act then the Project may dismiss you from its service forthwith without notice or salary in lieu thereof or other benefit then due to you, except salary earned to date of dismissal.

10. HOUSING.
Unless otherwise agreed in writing, the salary set out overleaf includes an element of 15% house allowance unless under the special conditions the Project provides basic housing accommodation.

11. DUTIES AND BEHAVIOR.

a) The nature of this Project business imposes very special responsibilities on its Employees. The Project shall therefore have the right from time to time to carry out such checks and investigations as it deems desirable in respect of your family, associates and activities in order to obtain a current integrity assessment In the interest both of the Project’s members, associates, donors and Sponsors and for the safety of the Project’s Other employees. The Project undertakes that such investigations will be conducted with discretion and in strict confidence and it is a condition of the Project’s service that you must assist in all such inquiries and must produce to The Project all information and documents as it will require.

b) During the whole of your service you will conform to such Project circulars and instructions as are in force from time to time and you will diligently and faithfully perform duties both as stated herein and such other duties within the scope of your abilities which the Project may call upon you from time to time to perform and devote the whole of your time to perform and devote the whole of your time, attention and abilities to the service of the Project. You will use your best endeavors to promote the interest of the Project and at all time obey the orders and directions given to you by the Project management employing you, and shall not participate in any other activity that is deemed to be of conflict of interest with the objectives of the Project

EMPLOYMENT TERMS AND CONDITIONS OF SERVICE

c) You will conduct yourself at all times during your service honestly courteously and properly and be of strictly sober and temperate habit.

d) You will not without consent of the Project, disclose any of its secrets or other confidential matters to anyone not authorized to receive them during your employment or after its termination.

e) If this agreement is terminated, you undertake to hand over to the Project all property of the Project for which you may be responsible together with any file, lists and notes that were given to you or compiled by you in the execution of your duties.


12. FURTHER AGREEMENTS AND UNDERTAKINGS.
In addition to the forgoing you will: -

a) Always regard yourself as a member of an honorable and important profession.
b) Not request or accept a gratuity of any nature or for any reason and your service shall be impartially efficient at all time to the best of your ability. During the whole of your service you undertake not to borrow money from any of our members, associates, donors or Sponsors.
c) Be partial in reporting unusual incidents regardless of the person or consequences involved so as to assist your superiors in arriving at a correct decision.
d) Not at any time either during the continuance of your service with the Project or afterwards either on your own account of for any other persons, organizations or Project, directly or indirectly solicit, canvass, interfere with or endeavor to entice away any person or organization who or which has been a member, associate, donor or Sponsor of the Project at any time during your employment.
e) Not at any time within two years after leaving the service of the Project for any reason whatsoever promote or be engaged or concerned in carrying on (whether solely or jointly with any persons, organization or Project) any Project business in competition with the Project within a radius of twenty five miles of any of our operating centers at which you may have been employed at any time during a period of twelve months immediately preceding such termination.
f) Not while employed by the Project take any employment in your spare time of whatsoever nature or take any interest in a concern similar to the Project or ancillary to such concern in particular whereby you will make use of the Project.
g) Not while employed by the Project take any concern which may require attendance at Board / Committee Meeting or any other attendance even though your service is not required.

13. COMPLETE AGREEMENT.
This agreement contains all the provisions of the Agreement between the Project and yourself and replaces all previous correspondence undertaking and warranting whether written or oral.

14. PROBATIONARY PERIOD.
Notwithstanding anything to the contrary in this Agreement the first months of your services as set out are a probationary period. This probationary period may be extended and shall be deemed to have been so extended until your appointment is confirmed in writing by the Project. In the event that you satisfactorily complete the probationary period then it shall count as good service for all purposes.

Re: Work Permits

I think this issue will be better tackled under the new NGO status as it will be official that we have international affiliation. At that point in time the Secretary will be incharge of processing all volunteer and other work permits and will provide the necessary guidelines for isssuing of the same.These permits are issued by the Immigration Department of the Government of Kenya.

We refer to the interview you attended at Baobab Family Project for the above-mentioned position and we are pleased to inform you that you were successful. The Project will engage you as a VOLUNTEER SOCIAL WORKER pending your availability and upon signing the relevant volunteer service agreement form.

The engagement will be for an initial period of six (6) months subject to review or for permanent employment. The Project has the discretion on the type of engagement on offer after the initial six (6) months. Volunteer Letters

I would like us to issue volunteer letters to vulunteers as a legal requirement. Kindly advise on who are volunteers in your opinion and their up keep allowances if any

We have managed to identify through the interviews we conducted a vounteer social worker by the name Victor Baya Thoya and we would like him engaged immediately Kindly advise on his up keep allowance.

My own observation is that local volunteers get similar up keep allowance. Would 2,000/= be okay with meals and accomodation catered for to be reviewd latter.
